Terms of Service

This is a working draft written to match how OBX'Server actually operates today, not generic boilerplate — but it has not been reviewed by a lawyer. Fields marked like this need your real information before this is safe to rely on, and a legal review is genuinely worth doing before this goes live, given real payments and organisational data pass through the service.

1. Who this agreement is with

OBX'Server is operated by [YOUR REGISTERED BUSINESS NAME], [REGISTRATION NUMBER, IF INCORPORATED], of [REGISTERED ADDRESS] ("OBX'Server", "we", "us"). These Terms govern your access to and use of the OBX'Server platform, including the account portal, your tenant site, and any related services (together, the "Service"). By creating an account, you agree to these Terms.

2. What the Service is

OBX'Server provisions a dedicated back-office site for your organisation, tailored to one of four supported categories: NGO/Nonprofit, Wellness, Cakes & Confectionery, or Food Order/Menu. Your site includes record-keeping, invoicing, and workflow tools appropriate to your category. We may add, change, or discontinue individual features over time as the Service develops.

3. Accounts and eligibility

You must provide accurate information when signing up and are responsible for keeping your login credentials secure. You must be authorised to act on behalf of the organisation or business you're signing up. One account per organisation — accounts may not be shared across unrelated businesses.

4. Free trial

New accounts start with a 14-day free trial. No payment card is required to start a trial. During the trial you can explore your dashboard and set up records; some features may be limited until you activate a paid plan. There is no automatic charge at the end of a trial — nothing is billed unless you choose to activate.

5. Subscriptions and billing

Paid plans are billed either monthly or yearly, at the price shown at the time you activate. Payments are processed by Paystack; OBX'Server does not store your card details. Once you activate a plan, the price you were charged is locked to your account — a later change to our published pricing does not retroactively change what you pay, for as long as your subscription stays active without a gap.

[CONFIRM REFUND POLICY] — as a starting default: subscription fees are non-refundable once a billing period has started, except where required by law. You can stop future billing at any time by cancelling; access continues until the end of the period you've already paid for.

6. Your data

You own the data you and your organisation enter into your site — donor records, customer records, orders, appointments, and everything else you create. We don't use your organisational data for anything other than providing the Service to you, and we don't sell it. See our Privacy Policy for how we handle personal data specifically.

7. Acceptable use

You agree not to use the Service to: break the law; store or process data you don't have the right to hold; attempt to access another account or tenant's site without authorisation; interfere with the Service's operation (including automated abuse of the signup or payment flow); or misrepresent your organisation's identity.

8. Service availability

We aim to keep the Service reliably available but don't currently guarantee a specific uptime commitment or service level. We'll make reasonable efforts to notify you of planned maintenance that affects your access.

9. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate accounts that violate these Terms, including confirmed abuse of the signup process or fraudulent payment activity.

10. Limitation of liability

The Service is provided "as is." To the fullest extent permitted by law, OBX'Server is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Changes to these Terms

We may update these Terms as the Service evolves. Material changes will be reflected by updating the date at the top of this page; continued use of the Service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria.
